POLICY
This Privacy Policy explains how Ergon Systems (“Ergon Systems,” “we,” “us,” or “our”) collects, uses, and protects information when you visit ergonsystems.com, fill out a form, book a call, or get emails or text messages from us.
Ergon Systems is a sole proprietorship run by Benjamin Schultz in the Temecula Valley, California. If you have questions, email benschultz@ergonsystems.com.
Information We Collect
Information you give us
- Free audit form: your name, business name, business type, mobile phone number, email address, approximate calls per week, any optional notes you add, and whether you checked the optional box agreeing to receive text messages.
- Contact form on our Home page: the information you choose to enter, such as your name, contact details, and message.
- Call bookings: when you book through our Google Calendar appointment page, Google collects your name, email address, phone number, and your answers to our booking questions, and shares them with us so we can prepare for the call.
- Emails and texts: if you email or text us, we receive your message, your email address or phone number, and the date and time.
Information collected automatically
- When you submit a form, we record the submission time and the page you submitted it from.
- Our website host, Base44, may set cookies and collect basic technical and usage information, such as browser type, device type, pages visited, and general location based on IP address. This helps keep the site running, secure, and working properly. You can block or delete cookies in your browser settings, but some parts of the site may not work as expected.
We do not knowingly collect sensitive information such as payment card numbers, Social Security numbers, or health information through this website. Please don’t include it in form notes.
How We Use Your Information
We use your information to:
- respond to your audit request or message;
- schedule, confirm, and prepare for calls you book;
- send you the information you asked for;
- follow up with you about your request;
- send text messages, only if you agreed to receive them;
- operate, maintain, secure, and improve our website and services; and
- comply with legal obligations and protect our rights.
We do not sell your personal information.
How We Share Your Information
We share information only with service providers that help us run our business, and only as needed for them to do that work:
- Base44: website hosting and the database that stores form submissions.
- Google Workspace: business email and calendar, including our appointment booking page.
- n8n: automation software that sends replies to form submissions and alerts us to new inquiries.
- Twilio: text messaging, once our SMS program is active.
These providers process information on our behalf under their own terms and privacy policies. We may also disclose information if required by law, to respond to legal process, to protect the safety, rights, or property of anyone, or in connection with a sale or transfer of the business.
Text Messaging (SMS)
If you check the optional consent box on our audit form or otherwise agree to receive texts, we may send you text messages about your inquiry, such as replies to your questions and appointment-related messages.
- Message frequency varies. Message and data rates may apply.
- To opt out, reply STOP at any time. You’ll get one message confirming you’ve been unsubscribed, and no more after that.
- For help, reply HELP or email benschultz@ergonsystems.com.
- Consent to receive text messages is not a condition of purchase of any goods or services.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

If we email you about your request, you can stop further follow-up emails at any time by replying “unsubscribe” to any email from us. We may still send messages you need, such as confirmations for a call you booked.
How Long We Keep Information
We keep personal information only as long as we reasonably need it for the purposes described above, such as responding to your inquiry, keeping records of our conversations, and providing services if you become a client, or as required by law. When we no longer need it, we delete it or make it de-identified. Records of SMS opt-ins and opt-outs may be kept longer so we can honor your choices and show that we did. You can ask us to delete your information at any time (see below).
How We Protect Information
We use reasonable administrative and technical measures to protect your information, such as using reputable service providers, limiting access to the accounts that store your data, and using secure (HTTPS) connections on our website. No method of transmission or storage is completely secure, so we can’t guarantee absolute security.
Your California Privacy Rights
If you are a California resident, you may have the following rights under California privacy law, including the California Consumer Privacy Act as amended by the California Privacy Rights Act:
- Right to know what personal information we have collected about you, where it came from, why we collected it, and who we share it with.
- Right to delete personal information we collected from you, subject to certain exceptions.
- Right to correct inaccurate personal information.
- Right to opt out of the sale or sharing of your personal information. We do not sell personal information, and we do not share it for cross-context behavioral advertising.
- Right to non-discrimination: we won’t treat you differently for exercising these rights.
How to make a request: email benschultz@ergonsystems.com with the subject line “Privacy Request,” tell us which right you want to use, and include the name and email or phone number you used with us. We may need to verify your identity before acting on a request. You may use an authorized agent, but we may ask for proof that they’re allowed to act for you. We’ll respond within the time required by law.
Even if you’re not a California resident, you’re welcome to ask us to access, correct, or delete your information, and we’ll do our best to help.
Children’s Privacy
Our website and services are meant for business owners and are not directed to children. We do not knowingly collect personal information from children under 13, or from anyone under 16 for California purposes. If you believe a child has given us personal information, email us and we’ll delete it.
Links to Other Sites
Our site links to services run by others, such as our Google Calendar booking page. Their privacy practices are governed by their own policies, not this one.
Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we’ll post the new version on this page and change the effective date at the top. If we make a material change to how we use your information, we’ll take reasonable steps to let you know.
